The most common accidents where you may not be at fault

If you have been in an accident, chances are that you may be questioning whether you are at fault, or was the other driver responsible for the crash. Depending on the type of crash you are involved in, you probably know that you were not to blame. But in either event, there must be proof of negligence to prevail in a personal injury lawsuit.

But in lieu of such proof, there are certain types of accidents where the moving party is almost always at fault. This post will highlight them.

Rear end collisions – When another car hits you from behind, it is more likely than not that the other driver is at fault. Simply put, it is difficult to be a hazard when you are not moving. Even if you are, one of the basic rules of the road is that the driver behind you is supposed to keep enough distance between you in order to safely make sudden stops and avoid hazards. On the other hand,

Left-turn collisions – When a crash involves one driver turning left at an intersection, the driver turning left is generally at fault. After all, the driver coming straight through the intersection has the right of way; which means that the driver turning left must yield to the oncoming vehicle. Indeed, there may be some question of fault if the driver going straight was speeding or ran a red light, but generally a turning driver is at fault.

Of course, there are some exceptions to this rule. To learn more about them, an experienced personal injury attorney can help.
