Louisiana Laws That Govern Motorcycle Accident Claims
Louisiana’s legal framework adds layers that most injured riders don’t anticipate, and insurance adjusters factor these rules into every settlement offer they make. Understanding how the system works before you accept anything matters.
Comparative Fault
Louisiana follows a modified comparative fault rule under La. Civ. Code Art. 2323, effective January 1, 2026. A claimant found 51 percent or more at fault can’t recover damages. A claimant found less than 51 percent at fault recovers damages reduced by their share of fault. Because insurers aggressively push fault onto motorcyclists, having attorneys who know how that fault percentage gets built and challenged is critical. We use police reports, witness accounts, video footage, and accident reconstruction analysis to protect our clients’ fault assignments from the start.
Filing Deadlines
For motorcycle accidents occurring on or after July 1, 2024, Louisiana’s filing deadline is two years from the date of injury under La. Civ. Code Art. 3493.1. Accidents occurring before that date retain a one-year window. Missing either deadline can eliminate the right to recover, regardless of how strong the underlying claim is.
Helmet Law, Lane Splitting, & Phone Use
Louisiana requires all riders and passengers to wear compliant helmets. Not wearing a helmet doesn’t automatically bar a claim, but an insurer or defense attorney can use it to argue that the absence worsened the injuries and seek a reduction in damages. Lane splitting (riding between lanes of moving traffic) is prohibited in Louisiana; two motorcycles may ride abreast within a single lane. A rider who was lane splitting at the time of a crash should expect that fact to enter any fault analysis. As of August 1, 2025, handheld phone use while driving is also illegal in Louisiana. Evidence of unlawful device use by an at-fault driver can support a negligence claim and strengthen the case against them.

The most common forms of driver negligence in motorcycle accident cases include distracted driving, failure to yield the right of way, unsafe lane changes into a motorcycle’s path, speeding, tailgating, and driving under the influence. Left-turn accidents are among the most dangerous for riders: drivers turning left frequently misjudge or simply don’t see an oncoming motorcycle and turn directly into its path. Motorcycles are smaller and less visible than passenger vehicles, and fault is sometimes incorrectly attributed to the rider by law enforcement or the opposing insurer. We investigate every contributing factor rather than accepting the initial fault narrative.
Road Hazards & Defective Equipment
Potholes, debris, oil spills, and uneven pavement pose outsized risk to motorcycles, which have less inherent stability than four-wheeled vehicles. A road defect that causes a minor inconvenience to a car can cause a motorcycle rider to lose control entirely. Defective components including braking systems, tires, and throttle mechanisms can also cause a crash independent of any rider error. When a component failure contributed to the accident, a product liability claim against the manufacturer may run alongside the negligence claim against the at-fault driver.
